What are the Requirements for UAE Trademark Registration ?

The Ministry of Economy is the authority determining the registration of trademarks in UAE. If any person aspires to use trademarks for differentiating goods, products or services from others, he/she can apply for registration as per the trademark laws. Trademark registration in UAE requires the following documents to be presented while filing the application:

  • Goods/services description along with soft copy of your trademarks image in black and white.
  • Power of attorney for application filing.
  • A copy of certificate of incorporation (for corporate entities only) of the applicant.
  • If registered in any other countries then Certificates of Trademark registration.
  • Legal translation of all wordings which might be included in the trademark. Translation from the language of origin to English and Arabic needed. The translation from English to Arabic can be arranged by Black Swan BSS.

United Arab Emirates has adopted the international classification of goods and services which comprise 45 classes (the exceptions are classes 32 and 33). Alcoholic beverages cannot achieve trademark protection. Each trademark class requires separate applications to be filed. With the main trademark, it may be possible to protect similar trademarks (as associated trademarks for the same owner) where the main elements are similar and there are only minor differences..

Trademark Registration Process in UAE

  • All applications for trademark registration is to be filed at the Ministry of Economy.
  • Within 30 days from the date of submission, the Ministry of Economy decides on the application.
  • If a trademark is accepted by the Ministry of Economy, it shall be announced in its bulletin and two Arabic newspapers before the registration. This is done at the expense of the applicant.
  • If a person has an objection to the registration of the trademark he can submit a written objection to the Ministry of Economy within 30 days from the date of the last announcement. If an objection is filed, the Ministry of Economy notifies the applicant with a copy of objection to his application within 15 days from the receipt of such an objection.
  • If objections are raised, the registration is finalised. After the registration, the trademark owner receives a certificate which contains:
  1. The trademark registration number in UAE
  2. Application and registration date
  3. Trade name or the owner’s name, nationality and place of residence
  4. Copy of the trademark
  5. Description of the products, goods or services that come under the trademark.

Validity of trademarks registration in UAE

Trademarks registered in the United Arab Emirates have a validity of 10 years which starts with the filing date. The registration can be renewed for periods of 10 years.
